Welcome to The Bicycle Exchange. By using our website and/or placing an order, you agree to these Terms of Service, our Privacy Policy, our Shipping Policy, our Returns & Refunds Policy, our Service Policy, and any other policies referenced on this website.

2. Use of the Website

- We reserve the right to refuse service or cancel orders at our discretion, including where there is a pricing error or suspected fraudulent activity.
- We may suspend, restrict, or terminate access to the website (including user accounts) where we reasonably believe there has been misuse, unlawful activity, or breach of these Terms.
- We do not guarantee that the website will be available at all times or that access will be uninterrupted, secure, or error-free.
3. Orders and Acceptance
- By placing an order, you make an offer to purchase goods from us.
- An order is considered accepted once the goods are dispatched or collected.
- We reserve the right to cancel or refuse any order prior to dispatch, including due to stock unavailability, pricing or description errors, or suspected fraud.
- All prices are listed in Australian Dollars (AUD) and include GST where applicable.
4. Payment
- Payments are processed securely via third-party payment providers.
- You must provide valid and accurate payment information.
- You authorise us to charge your selected payment method for the total purchase price, including shipping and any additional charges.
5. Shipping & Delivery
- Please refer to our Shipping Policy for full details regarding shipping methods, costs, and delivery timeframes.
- Title (ownership) and risk in the goods pass to you upon delivery, collection, or handover to your nominated carrier.
- We are not responsible for loss, delay, or non-delivery resulting from incorrect or incomplete delivery information supplied by you.
5A. Click & Collect / In-Store Collection
- Valid photo identification matching the order details may be required at collection.
- We reserve the right to refuse collection if identification cannot be provided.
6. Returns & Refunds
- Returns, refunds, and exchanges are governed by our Returns & Refunds Policy.
- Nothing in these Terms limits or excludes your rights under the Australian Consumer Law.
- Lifetime Free Basic Servicing and any voluntary assurance programs do not, by themselves, create an automatic right to a return, refund, or exchange.
6A. Bike Shipping & Assembly
- Bicycles may be shipped partially disassembled.
- If you are not confident assembling a bicycle, we recommend using a qualified bicycle mechanic.
- To the extent permitted by law, we are not responsible for damage, injury, or loss arising from incorrect or improper assembly after delivery or collection.
7. Product Information, Descriptions & Images
- Product descriptions and images are provided in good faith but may contain errors or variations.
- Images are illustrative only and may not reflect exact specifications.
- We reserve the right to correct errors or cancel orders where inaccuracies are identified.
8. Consignment & Third-Party Goods
- Some goods may be sold on a consignment or agency basis.
- Where applicable, this will be disclosed in the product listing.
9. Pre-Owned / Second-Hand Goods
- Pre-owned and second-hand goods may show signs of prior use.
- Condition details should be reviewed carefully before purchase.
- Consumer guarantees apply with regard to age, price, and condition.
10. Servicing, Warranties & Consumer Guarantees
- All goods supplied by The Bicycle Exchange come with guarantees that cannot be excluded under the Australian Consumer Law.
- Manufacturer warranties apply where offered by the manufacturer.
- Our Warranty & Claims Policy explains how warranty, fault, and consumer guarantee claims are assessed for both new and second-hand goods.
- We offer Lifetime Free Basic Servicing and a 90-Day Voluntary Mechanical Assurance as described in our Service Policy and Warranty & Claims Policy. These programs are provided in addition to, and do not limit, your rights under Australian Consumer Law.
- Lifetime Free Basic Servicing is provided at The Bicycle Exchange workshop location only (Williamstown, VIC) and is not available through third-party service providers or other outlets.
- Routine servicing, inspection, or adjustment does not, by itself, indicate a fault or defect.
11. Events, Pop-Ups & Promotional Sales
- Event-specific or promotional sales may have additional terms disclosed at the point of sale.
- Australian Consumer Law rights continue to apply.
12. Force Majeure
- We are not responsible for delays or failure to perform obligations due to events beyond our reasonable control.
13. Intellectual Property
- All website content is owned by or licensed to The Bicycle Exchange.
14. Third-Party Links
- We are not responsible for third-party websites linked from our Services.
15. Limitation of Liability
- To the extent permitted by law, we are not liable for indirect or consequential loss.
- Our liability for goods is limited to remedies required under Australian Consumer Law.
16. Indemnity
- You agree to indemnify The Bicycle Exchange against losses arising from misuse or breach of these Terms.
17. Changes to These Terms
- We may update these Terms from time to time. Updated versions will be posted on this website.
